Birthing Injury & Obstetrics

The world of Medical Negligence can be quite overwhelming. That’s why we’ve broken it down in an easy way, so you can hopefully find what you’re looking for. Here are all the areas we cover regarding Birthing and Obstetric Claims.

Birthing and Obstetrics Claims

Giving birth should be a truly special time in anyone’s life. But, what should you do if something terrible happens during your pregnancy or whilst you are giving birth? Both you and your baby could be terribly injured and, as horrendous as it may sound, it does happen. And, when it happens because another person has been negligent, which simply means that it was someone else’s fault, you may be eligible to claim for compensation.

Regent Law Solicitors are specialists in compensation claims. We can advise on the likelihood of any claim you make being successful – we just need a few minutes of your time. Speak to one of our experienced compensation claims advisors free of charge today on 01204 201296. Alternatively, you can fill in a contact form and we’ll call you back.

WHY DO BIRTH INJURIES OCCUR?

There are a number of reasons why a birthing injury might occur, but the ones that appear to be most common are from:

  • errors that appear in the antenatal screening and scanning
  • physical injuries to mothers that have occurred during pregnancy or birth
  • stillbirths or neonatal deaths

The current state of the NHS is also a cause for concern. The cuts in funding have meant cuts in staffing levels and midwives have been as affected as much as all other areas of the NHS.

This decrease in staffing levels has had a terrible impact on care, and unless there are drastic changes, it’s only set to get worse. This is why we’ve seen a surge in the number of birth injury negligence claims over the past few years.

If you believe that you, or your baby, have suffered a birth injury and you think it may be due to negligence, contact us. We can tell you quickly and easily if your claim for compensation is likely to be successful.

TYPES OF BIRTHING INJURIES

There are many different types of birthing injuries. Here’s list of some of the most common ones we deal with:

  • Ectopic Pregnancy Compensation Claims
  • Rhesus Disease Compensation Claims
  • Pre-eclampsia Compensation Claims
  • Stillbirth Compensation Claims
  • Gestational Diabetes Compensation Claims
  • Cerebral Palsy Compensation Claims
  • Congenital Hip Dysplasia Claims
  • Hyperbilirubinemia and Kernicterus Compensation Claims
  • Retained Products of Conception

IT’S NOT PERSONAL

Claiming compensation is not personal. Each and every healthcare professional working in the UK has to be covered by professional insurance, for time just like this. And those working in the birthing suites are not an exception.

Even if that healthcare professional is a trusted friend,  if negligence has occurred, you should still explore the possibility of claiming – it’s to help you and your baby. And, if your claim is successful, your compensation is paid by the insurance company. It does not come out of the pocket of the person who’s guilty of negligence.

Think of how car insurance works, this works the same. A driver takes out a policy to cover the costs of being in an accident, that’s considered to be their fault. When the other person in the accident makes a claim for whiplash, for example, it’s your insurance company that makes the payment if the claim succeeds – not the driver.

People are afraid of making claims for compensation, but there’s nothing to be frightened of, we’ll help you through the process, every step of the way.

WHY YOU SHOULD MAKE A CLAIM FOR COMPENSATION

Compensation is designed to help you. It’s meant to make your everyday life as normal as possible for you and your family. So, if you’ve suffered from a birth injury that is preventing you from returning to work – that’s what compensation is for!

Maybe your child was born with cerebral palsy, and as they grow they’ll need expensive medical equipment, such as wheelchairs and hoists, just to cope with everyday life – that’s what compensation is for! Or maybe your child now requires constant nursing care that you can’t cope with – that’s what compensation is for!

HOW MUCH WILL I GET?

Everyone’s claim is entirely different, so it is difficult to advise accurately. However, we may provide a rough estimate of what you may receive. These estimates are based on your injuries and also other factors, such as psychological problems and missed time at work.
